Introduction

These Terms & Conditions (the "Terms") govern your access to and use of the Glammr mobile applications, websites, and related services (collectively, the "Services").

Glammr is a marketplace that helps clients find and book independent beauty service providers ("Stylists"). Glammr is operated by Glammr Marketplace Inc., a corporation incorporated in Ontario, Canada.

By creating an account, checking the acceptance box, accessing, or using the Services, you agree to these Terms.

The Services are operated by Glammr Marketplace Inc. ("Glammr", "we", "us", or "our").

Internet Agreement Disclosures

Before you complete a booking, Glammr displays the service description, the Stylist identity available in the booking flow, the appointment date and time, the booking subtotal, each mandatory platform fee, applicable taxes, the total amount payable in CAD, the accepted payment method, and the cancellation and refund rules that apply to the booking.

For bookings and other online purchases, Glammr provides an electronic confirmation record containing the material terms of the transaction. If applicable law requires a copy of the internet agreement, we will deliver it electronically within the period required by law.

Nothing in these Terms limits any non-waivable right you may have under the Consumer Protection Act, 2002 (Ontario) or any other applicable consumer protection law.

Accounts

You must provide accurate information and keep your account information up to date.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You may not share accounts, use someone else's account, or attempt to access the Services in an unauthorized manner.

Eligibility

You must be at least the age of majority in your province or territory of residence to use the Services.

If you are under the age of majority, you may only use the Services with the consent and supervision of a parent or legal guardian who accepts these Terms.

Identity and Security

To help keep the marketplace safe, we may require verification steps for certain features, such as confirming contact information, payment method details, device signals, payout details, government-issued identity information, or other fraud-prevention information.

Unless we expressly state otherwise in the Services, these checks are limited platform checks only. They are not a promise that any Stylist, Client, or booking has been licensed, certified, screened, background-checked, insured, or otherwise approved for quality or safety.

We may send you service-related communications (for example, booking confirmations and security notices) even if you opt out of marketing messages.

Suspension and Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, or create risk or potential legal exposure for us or others.

You may stop using the Services at any time. Payment obligations, dispute obligations, indemnities, and any surviving licenses continue after termination.

Marketplace Relationship and Stylist Independence

Stylists are independent contractors who control how they provide services, including their pricing, availability, business practices, and the quality of services they provide.

Glammr does not employ Stylists, does not supervise or control how Stylists perform services, and is not responsible for the acts or omissions of Stylists or Clients.

When you book a service, you are contracting directly with the Stylist for the in-person service, subject to these Terms and any additional terms the Stylist lawfully discloses.

Glammr is not a salon, spa, clinic, or insurer, and does not inspect, supervise, or control appointment locations, tools, products, equipment, sanitation practices, or the conduct of any user during an appointment.

Non-Discrimination and Equal Access

Glammr expects Clients and Stylists to treat one another lawfully and respectfully. You must not refuse, limit, or condition access to the Services or to a booking on the basis of any protected ground under applicable human rights or anti-discrimination law.

Protected grounds may include race, colour, ancestry, ethnic origin, citizenship, place of origin, religion, sex, sexual orientation, gender identity or expression, age, marital status, family status, or disability, subject to any lawful and non-discriminatory service limitations you disclose in advance.

We may investigate discrimination complaints, require additional information, remove content, cancel bookings, limit account access, or take other enforcement action where we reasonably believe this section or applicable law has been violated.

Assumption of Risk and No Duty to Supervise

You understand that in-person beauty services and in-person appointments may involve risks, including allergic reactions, burns, cuts, infections, dissatisfaction with results, property damage, theft, assault, harassment, and other personal injury, loss, or damage.

By booking, providing, receiving, or attending an appointment through the Services, you voluntarily assume all such risks to the maximum extent permitted by law.

Glammr does not undertake, and expressly disclaims, any duty to supervise, inspect, control, monitor, or ensure the safety, legality, quality, suitability, licensing, sanitation, or fitness of any Stylist, Client, appointment, appointment location, tool, product, or equipment.

Sensitive Information and Health-Related Details

Some bookings may involve sensitive information, including allergies, skin sensitivities, medications, medical conditions, pregnancy-related information, or accessibility needs. You should share only the information reasonably necessary for the booking.

By providing sensitive information through the Services, you consent to Glammr using and disclosing that information only as needed to facilitate the booking, support safety or dispute workflows, and comply with law.

Glammr is not a health information custodian, clinic, or medical provider. Stylists remain responsible for understanding and complying with any professional, health-privacy, or recordkeeping obligations that apply to the services they provide.

Non-Circumvention and Off-Platform Solicitation

Users who meet, communicate, or transact through the Services may not use the Services to avoid Glammr's role in facilitating bookings, payments, communications, marketplace rules, or trust and safety protections.

You must not directly or indirectly solicit, encourage, or arrange with another user introduced through the Services to book, pay for, or continue substantially similar services outside the Services for the purpose of avoiding platform rules, fees, payment processing, or protections.

You must not share contact details, payment details, external booking links, social media handles, or similar information through the Services for the purpose of moving a booking or user relationship off the platform.

This restriction does not apply to relationships you can show existed independently before the relevant users connected through the Services.

If we reasonably believe you violated this section, we may suspend or terminate your account, restrict pending payouts where permitted by law, cancel affected bookings, remove content, and seek recovery of fees, losses, or other amounts permitted by applicable law.

Bookings, Changes, and No-Shows

Bookings are subject to availability and acceptance by the Stylist. A booking request may expire or be rejected if not accepted within the applicable window.

Certain actions such as check-in, starting service, completing service, rescheduling, and canceling are governed by the booking lifecycle and platform rules.

Add-ons and selected options are locked at reservation time to keep pricing and payment authorization predictable.

Check-In and Starting Service

For some bookings, the Client must check in near the scheduled start time. The Stylist may be unable to start the service through the app until check-in occurs.

If payment authorization is required for the booking, the service may not begin until authorization succeeds.

Cancellations and Rescheduling

Nothing in this section limits any statutory right to cancel under applicable consumer protection law.

Cancellations and rescheduling are allowed only before check-in, subject to platform rules and any non-waivable legal rights.

If you reschedule, the booking may return to a pending or confirmation state and require the Stylist to confirm again.

Fees, if any, are calculated based on the scheduled start time at the moment of cancellation or reschedule.

Client Cancellation Fees

If a Client cancels at least 72 hours before the scheduled start time, no cancellation fee is charged.

If a Client cancels within 72 hours of the scheduled start time, the following cancellation fees may apply as a percentage of the booking price:

48-72 hours before start: 5%.

24-48 hours before start: 10%.

Less than 24 hours before start: 15%.

Stylist Cancellations

If a Stylist cancels before check-in, the Client will be refunded for the service charge if already captured.

Glammr may apply platform rules and fees to Stylists in connection with late cancellations to help protect marketplace reliability.

Reschedule Fees

Client-initiated reschedule: a fee of 10% of the booking price may be charged at the time of rescheduling.

Stylist-initiated reschedule: Glammr may apply a fee to the Stylist in connection with rescheduling under platform rules.

Where platform rules provide for it, a portion of certain fees may be shared with the non-fault party.

No-Show Policy

If neither party checks in within the applicable grace period after the scheduled start time, the booking may be treated as a no-show under platform rules.

Client no-show fees may apply, generally aligned with the less-than-24-hours cancellation tier above.

In the event of a dispute, we may rely on available signals such as in-app check-in, relevant chat messages, and device telemetry to administer no-show outcomes.

Payments, Authorizations, and Fees

Payments are processed by third-party payment processors such as Stripe. You authorize us and our processors to charge your selected payment method for amounts you owe under these Terms.

For bookings, we may place a temporary authorization hold on your card near the time of service and capture the final amount when the service is completed, in accordance with platform rules.

Some fees, such as cancellation, reschedule, or no-show fees, may be charged immediately when triggered by your actions or applicable rules.

Tips and gratuities are not collected through the Services unless we expressly add that functionality in the future.

Marketplace Payments and Stripe Connect

When in-app payments are enabled, Glammr uses a Stripe Connect separate charges and transfers model. Glammr charges the Client through Glammr's own Stripe account, retains the applicable platform fees and commission, and transfers the Stylist's net earnings to the Stylist's connected Stripe account.

The Stylist remains the supplier of the underlying beauty service, and Stripe's connected account terms apply to the Stylist's payout account.

We do not store full card numbers. Payment information is handled by our payment processors in accordance with their terms and privacy policies.

Refunds

Refund eligibility depends on the booking status, applicable rules, and circumstances, including Stylist cancellations and failed payment captures.

Refund timing depends on your payment method and processor timelines.

Chargebacks and Payment Disputes

If you initiate a chargeback or payment dispute, we may temporarily restrict your account while we investigate and respond.

You agree to cooperate by providing information reasonably requested to resolve disputes.

Messaging

Messaging is offered to help Clients and Stylists coordinate about an active booking.

Messages may only be sent when a booking is in eligible states. Threads may become read-only outside those states.

Messaging features may be limited or restricted based on booking status, trust-and-safety controls, anti-spam protections, or other platform rules enforced per booking thread.

User Content, Reviews, and Moderation

You may be able to upload content such as photos and messages and submit reviews. You are responsible for ensuring you have the necessary rights and permissions, including consent from any individuals depicted.

You grant Glammr a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content as necessary to operate the Services and provide it to intended recipients.

We may remove or restrict content, and we may take enforcement action, where content violates these Terms or applicable law, or where it creates safety risks.

Acceptable Use

You agree not to misuse the Services, interfere with or disrupt the Services, attempt to access non-public areas, reverse engineer, scrape or harvest data, or use the Services for unlawful, harmful, or fraudulent purposes.

You agree not to post or transmit content that is illegal, defamatory, harassing, hateful, sexually exploitative, or that infringes intellectual property rights.

Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Glammr does not guarantee the quality, timing, or outcome of services performed by Stylists and does not make representations about Stylist licensing or qualifications beyond what is expressly stated in the Services.

Users are solely responsible for deciding whether to book, provide, or receive services through the Services, for communicating allergies, sensitivities, medical conditions, and other relevant information, and for taking reasonable precautions in connection with any appointment.

To the maximum extent permitted by law, Glammr is not responsible for personal injury, death, allergic reactions, burns, infections, property damage, theft, assault, harassment, or other harm arising out of or related to in-person appointments, services provided by Stylists, the acts or omissions of Clients or Stylists, or the condition of any appointment location, tools, products, or equipment, whether such claim is asserted in contract, tort (including negligence), statute, or otherwise, except to the extent the harm is caused by Glammr's gross negligence, willful misconduct, or, in Quebec, intentional or gross fault.

Limitation of Liability

To the maximum extent permitted by law, Glammr will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill.

Without limiting the foregoing, and to the maximum extent permitted by law, Glammr will not be liable for claims arising from the provision, receipt, or outcome of beauty services booked through the Services, including claims for bodily injury, illness, death, emotional distress, or property damage, whether such claim is asserted in contract, tort, statute, or otherwise, except to the extent the harm is caused by Glammr's gross negligence, willful misconduct, or, in Quebec, intentional or gross fault.

To the maximum extent permitted by law, Glammr's total liability for all claims relating to the Services will not exceed the greater of (a) $100 CAD and (b) the total platform fees paid by you to Glammr in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, these limitations apply only to the extent permitted by law.

Indemnity

You agree to indemnify and hold Glammr harmless from any third-party claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Services, your content, your breach of these Terms, or your violation of any law or the rights of any third party.

This includes third-party claims arising from services or appointments you provide, receive, or participate in, except to the extent the harm is caused by Glammr's gross negligence, willful misconduct, or, in Quebec, intentional or gross fault.

Dispute Resolution

Before starting a formal legal proceeding against Glammr, you agree to send a written Notice of Dispute to the contact information in these Terms describing the issue and the relief requested. We will also send you written notice before starting a formal legal proceeding against you where reasonably practicable.

The parties agree to work in good faith for at least 45 days after a Notice of Dispute is received to try to resolve the matter informally.

If the dispute is not resolved informally, the parties may agree to use mediation or arbitration where lawful and appropriate. Unless we both agree otherwise, either party may still bring the dispute in court as described below.

To the maximum extent permitted by law, disputes between you and Glammr must be brought on an individual basis and not as part of a class, collective, representative, or private-attorney-general proceeding. If applicable law makes part of this paragraph unenforceable, the unenforceable portion is severed and the rest remains in effect.

Right to Cancel

If applicable law gives you a statutory right to cancel an internet agreement, direct agreement, or other consumer agreement, that statutory right prevails over any conflicting provision in these Terms.

If we fail to provide information or deliver a copy of the agreement when required by law, you may have additional cancellation rights. To exercise those rights, contact us at the email address listed below.

Governing Law and Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules.

Except where prohibited by law and unless the parties agree to another lawful dispute-resolution process, you agree that any dispute relating to these Terms or the Services will be brought in the courts located in Ontario, Canada, and you submit to their personal jurisdiction.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting updated Terms in the app or on our website.

If applicable law requires renewed consent or another acceptance step before updated Terms apply to you, we will follow that process.
